Au Canada, des mesures l\u00e9gislatives strictes visent \u00e0 garantir la transparence et l'authenticit\u00e9 des d\u00e9clarations des entreprises en mati\u00e8re de d\u00e9veloppement durable. Une bonne partie des <a href=\"https:\/\/cse-net.org\/fr\/trainings\/canada-sustainability-esg-course-april-2024\/\">Le programme phare du CST en mati\u00e8re de d\u00e9veloppement durable pour les cadres sup\u00e9rieurs<\/a> se concentre sur les ESG et la l\u00e9gislation canadienne sur l'\u00e9coblanchiment.<\/p>\n<h4>L\u00e9gislation canadienne sur l'\u00e9coblanchiment et plus encore<\/h4>\n<p>La principale arme du Canada contre l'\u00e9coblanchiment r\u00e9side dans la loi sur la concurrence, qui interdit la publicit\u00e9 fausse ou trompeuse, y compris les all\u00e9gations environnementales trompeuses. Le Bureau f\u00e9d\u00e9ral de la concurrence, charg\u00e9 de l'application de la loi, souligne l'importance d'informations exactes et fond\u00e9es dans les communications des entreprises avec les consommateurs. Toutefois, des d\u00e9veloppements r\u00e9cents ont remodel\u00e9 le paysage r\u00e9glementaire. Le guide des d\u00e9clarations environnementales de l'Association canadienne de normalisation (CSA), qui \u00e9tait autrefois une pierre angulaire, a \u00e9t\u00e9 modifi\u00e9, <a href=\"https:\/\/ised-isde.canada.ca\/site\/competition-bureau-canada\/en\/how-we-foster-competition\/education-and-outreach\/publications\/environmental-claims-guide-industry-and-advertisers\">est archiv\u00e9 depuis novembre 2021<\/a>Les entreprises sont donc moins bien guid\u00e9es \u00e0 une \u00e9poque o\u00f9 l'on exige une plus grande responsabilit\u00e9.<br \/>\nLe <a href=\"https:\/\/www.canada.ca\/en\/department-finance\/programs\/financial-sector-policy\/sustainable-finance\/sustainable-finance-action-council\/taxonomy-roadmap-report.html\">Rapport sur la feuille de route en mati\u00e8re de taxonomie<\/a> du minist\u00e8re des Finances du Canada souligne l'urgence pour les entreprises d'augmenter rapidement leurs investissements dans le domaine du climat, avec un objectif d'\u00e9conomie nette z\u00e9ro d'ici \u00e0 2050. Alors que le Canada est aux prises avec un d\u00e9ficit d'investissement climatique estim\u00e9 \u00e0 $115 milliards par an, les entreprises sont soumises \u00e0 une pression croissante pour fixer des objectifs ambitieux en mati\u00e8re de r\u00e9duction de leur impact sur l'environnement.<\/p>\n<h4>Exemples d'\u00e9coblanchiment<\/h4>\n<ul>\n<li><strong>Emballage trompeur<\/strong>: Les entreprises qui se targuent de pratiques durables peuvent \u00eatre victimes d'\u00e9coblanchiment si leur emballage contredit ces affirmations. Les dirigeants doivent s'assurer que l'emballage du produit est conforme \u00e0 l'engagement environnemental d\u00e9clar\u00e9.<\/li>\n<li><strong>Langue ambigu\u00eb<\/strong>: L'utilisation de termes tels que \"100% natural\" sans justification claire peut induire les consommateurs en erreur. Les professionnels du d\u00e9veloppement durable doivent privil\u00e9gier la transparence et la pr\u00e9cision du langage pour \u00e9viter tout malentendu.<\/li>\n<li><strong>\u00c9valuations du cycle de vie incompl\u00e8tes<\/strong>: Les dirigeants doivent proc\u00e9der \u00e0 des \u00e9valuations approfondies du cycle de vie afin d'\u00e9viter de s\u00e9lectionner des donn\u00e9es qui donnent une image plus positive de l'impact environnemental d'un produit que ce qui est exact.<\/li>\n<\/ul>\n<h4>Cas canadiens d'\u00e9coblanchiment<\/h4>\n<p>En <a href=\"https:\/\/climatecasechart.com\/\">Tableau des cas climatiques,<\/a> qui fournit une base de donn\u00e9es sur les litiges li\u00e9s au changement climatique aux \u00c9tats-Unis et une base de donn\u00e9es mondiale, dans la cat\u00e9gorie \"publicit\u00e9 trompeuse\" de la base de donn\u00e9es mondiale, parmi les 56 cas r\u00e9pertori\u00e9s, il y en a trois qui concernent le Canada. Shell Canada<\/a>En premier lieu, le plaignant affirme que le programme \"Drive Carbon Neutral\" de Shell viole la loi canadienne sur la concurrence en donnant des indications fausses et\/ou trompeuses au public. Deuxi\u00e8mement, <a href=\"https:\/\/climatecasechart.com\/non-us-case\/greenpeace-canada-v-pathways-alliance\/\">Greenpeace Canada c. Pathways Alliance<\/a>La Commission europ\u00e9enne a publi\u00e9 un rapport sur la campagne publicitaire \"Let's clear the air\" de la Pathways Alliance, dans lequel elle affirme que cette campagne donne des indications fausses et\/ou trompeuses au public. En outre, <a href=\"https:\/\/climatecasechart.com\/non-us-case\/amberg-corp-and-olga-kiiker\/\">Amberg Corp. et Olga Kiiker<\/a>Ces derniers ont \u00e9t\u00e9 inculp\u00e9s de 25 chefs d'accusation pour ne pas avoir respect\u00e9 la loi sur la gestion des \u00e9missions et la r\u00e9silience climatique et le r\u00e8glement sur l'innovation technologique et la r\u00e9duction des \u00e9missions.<br \/>\nLa sanction pour des d\u00e9clarations fausses ou trompeuses peut \u00eatre aussi simple qu'une injonction du tribunal \u00e0 cesser le comportement en question ou plus grave, comme des amendes ou m\u00eame une peine de prison.<\/p>\n<p>En outre, le respect de la l\u00e9gislation canadienne est devenu plus difficile en raison de l'absence de mise \u00e0 jour des lignes directrices de la CSA. Les entreprises font d\u00e9sormais l'objet d'un examen plus approfondi et sont moins bien orient\u00e9es.
